Welcome to Hide-and-Spell ("we," "our," or "us"). By accessing or using our application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
To use most features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring, periodic basis. All payments are handled by our third-party payment processor, Stripe. We do not store your credit card details.
You may create or upload content, such as custom word lists ("User Content"). You retain all rights to your User Content, but you grant us a worldwide, royalty-free license to use, reproduce, and display such User Content as necessary to provide the Service to you. You are solely responsible for your User Content and for ensuring that any words you add are appropriate for children.
The Service uses artificial intelligence (AI) to generate spelling prompts and other content. While we strive to ensure the AI-generated content is appropriate, we cannot guarantee its suitability. **You are responsible for reviewing all AI-generated content, including audio prompts, before use with a child.**
If you cancel your subscription, your account and all associated data (including child profiles, word lists, and progress data) will be maintained for a period of three (3) months. After this period, we reserve the right to permanently delete all of your data from our systems.
We do not guarantee 100% uptime for all functionalities of the Service. In the event of prolonged and unscheduled system unavailability, we may, at our discretion, offer a partial refund of your subscription fee for the affected period.
We maintain regular backups of our database. In the event of a data loss incident, we will make every reasonable effort to restore your data from the most recent backup. However, we do not guarantee that we can recover all data to its most recent state. We will notify affected users of any significant data loss incidents.
You agree not to engage in any of the following prohibited activities: (i) using the Service for any illegal purpose; (ii) attempting to interfere with the proper working of the Service; (iii) uploading any content that is unlawful, harmful, or infringes on the rights of others.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
In no event shall Hide-and-Spell, nor its directors or employees, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from your use of the Service.
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
